USPlabs OxyElite Pro. Linked to Liver Failure
One allegation against the USPlabs accused the company of neglecting to properly test their products for adverse effects, as well as actively ignoring tests that revealed their product may cause liver damage. As a result, from April 10, 2013 to October 24, 2013, 72 users of OxyElite Pro. suffered from non-viral hepatitis, of which 47 were hospitalized, at least 3 received a liver transplant, and one death was reported.
In response to this outbreak of liver damage, in November of 2013, the FDA issued a report which warned consumers and retailers of this risk . At this point USPlabs was ordered by the FDA to immediately recall and cease distribution of OxyElite Pro.; yet, subsequently, USPlabs blatantly violated that order and secretly continued to sell their dangerous product to unsuspecting retailers nation-wide.
USPlabs Charged in 11-Count Indictment
The 11-count indictment included details of many appalling alleged misdeeds. Another allegation claimed that USPlabs conspired with Chinese suppliers to create fake documentation in order to deceive regulators and consumers regarding the ingredients used in their supplements. As one email exchanged included in the indictment revealed, USPlabs owners joked that “lol stuff is 100% synethic [sic]” when referring to their supplements marketed as being made from natural plants extracts.
These investigations and indictments were the result of a “yearlong sweep of dietary supplements to identify potentially unsafe or tainted supplements” conducted by the FDA , in partnership with other government agencies. The Department of Justice reported, “the sweep resulted in civil injunctions and criminal actions against 117 various manufacturers and/or distributors of dietary supplements and tainted products falsely marketed as dietary supplements. ”
