Pool Diving Injuries
A pool diving injury can occur when the head of the diver strikes the bottom or side of the pool, often as the result of diving into shallow water. Many diving accidents are avoidable, but when one does occur, it is usually due to one or more of the following causes:
- Poor swimming pool design
- Improper swimming pool installation
- Lack of proper pool maintenance, for example water depth or clarity
- Inadequate lighting
- Inadequate warning signs
- Inadequate water depth markings
- Defective diving boards
- Improper installation of diving boards
- Inadequate barrier fencing
- Inadequate supervision, and/or behavior of other swimmers
- Alcohol consumption
A Diving Accident Can Result In Serious Injury or Death
Diving accidents are a major cause of facial, head and traumatic brain injury, and spinal cord injuries. As the head impacts the bottom or side of the pool, or strikes a concealed, underwater object, it can cause the spine to dislocate or fracture. The vulnerable spinal cord, which is protected by the spine, can become bruised, swollen, or torn as a result of this trauma. Among the most debilitating of injuries, spinal cord injuries can result in paralysis, including quadriplegia and paraplegia, depending on where on the spine the injury occurred. Lacerations to the face and broken facial bones are other common injuries related to a diving trauma. Diving accidents can also result in death, often due to drowning.
Diving Accident Lawsuits
Given the circumstances, a diving accident injury claim may be brought against the property owner; pool manufacturer, seller, or installer; or the pool liner company. Liability is often based on failure to warn and/or product defect theories and together with the nature of the injuries, experts in pool design, human factors engineering, depth perception, neurology, life care planning, and economic loss may be required for case preparation and trial.
