About The Volkswagen Scandal – “Defeat Device” Used To Cheat On Emissions Testing

On September 18, 2015, and again on November 2, 2015, the U.S. Environmental Protection Agency (EPA) issued Notices of Violation to Volkswagen for its failure to comply with the Clean Air Act. The EPA alleges that certain Volkswagen and Audi diesel cars from model years 2009 – 2015 and certain Audi and Porsche light duty diesel vehicles for model years 2014 – 2016 were equipped with concealed software that can circumvent substandard emissions test results.

Known as a “defeat device,” the software is designed to detect when the vehicle is undergoing emissions testing, and triggers full emissions control at that time. However, under normal driving conditions, the vehicles’ pollution control system is significantly reduced. As a result, vehicles meet emissions standards when tested in laboratories or testing stations, but emit nitrogen oxides from 9 to 40 times the standards permitted by the EPA during normal operation.
